Know Your Rights to Privacy From Telemarketers
Legally, most telemarketers are permitted to call you, but there are some restrictions on the calls they are allowed to make. The reason is people have certain rights in regard to their phone privacy, and telemarketing firms can be fined if they violate a telephone consumer’s privacy. Thus, it is important that you know what your rights are, so you know when you can take action.
How can you find out what your rights are as a phone consumer? The answer is the Telephone Consumer Protection Act (TCPA). Passed as a law in 1991, the TCPA was created by the Federal Communications Commission (FCC) to provide the rules and regulations that telemarketing companies must follow.
The following is a brief list of your privacy rights based on the rules of the TCPA:
– Telemarketers are not permitted to phone you prior to 8 am or past 9 pm.
– Should you request to be placed on a telemarketing firms internal do-not-call-list, they must comply with your wishes, and not call you back, even if you have an existing business relationship with them.
-Unless you have given your authorization, a telemarketing organization is not allowed to contact you using an automated message.
– If a telemarketer leaves a message on your voice mail or answering machine, they must say who they are and the company they are calling on behalf of, as well as leave a number that you can call back to request to be placed on their do not call list if that is your wish.
– It is illegal for telemarketers who use autodialing devices (virtually all of them) to call your cellular phone, unless you have authorized them to do so. An autodialer is a type of technology that dials phone numbers for telemarketers.
Knowing your rights is important, but it also helps to know the rights of telemarketing companies. Therefore, you should carefully read over the TCPA to know exactly where you stand. That way, you will know when you can legally file a complaint to stop telemarketers and annoying calls and actually protect your privacy.
